Wouldn't that also mean legal for poor people? What are they going to do? Take your last 12 Cents and offer 150 installments of 1$ / month?

Put you in jail for a day? Free food, a shower, somewhere warm to stay, softer bed than a bench or below a bridge.

Also if you're a known repeated offender the fines may go up or lead to other punishment, such as social service or jail time.

Even if not, punishable by a fine would only mean "legal for people that have enough money to pay the fine and don't give a crap about their money". The later part does not mean you have to be rich. Otherwise fewer people would buy expensive branded things when they could get the same performance from another, cheaper brand.
